Ilyias Austin petitioned for relief after a district court denied his motion for a preliminary hearing. The Colorado Supreme Court determined Austin was charged by information with a class 4 felony committed as a “crime of violence” as defined at section 18-1.3-406(2)(a)(I)(B) and (II)(C) of the revised statutes, and as such, he was statutorily entitled to a preliminary hearing.
