The Wisconsin Constitution, Article I, section 26, protects the right to hunt. Since 1990, Wisconsin has had a special statute making it a crime to harass hunters in various ways; a 2016 amendment makes it a crime to interfere intentionally with a hunter by “maintaining a visual or physical proximity” to the hunter, by “approaching or confronting” the hunter, or by photographing, videotaping, audiotaping, or otherwise recording the hunter's activity. The plaintiffs oppose hunting. They have observed hunters on public land, have sometimes approached and confronted them, have photographed and filmed hunters’ activities, and intend to continue all those activities.The plaintiffs assert that the prohibitions violate the First and Fourteenth Amendments to the U.S. Constitution. In a pre-enforcement challenge, the district court granted the defendants summary judgment, finding that the plaintiffs lacked standing to bring an as-applied challenge to the law and that their facial constitutional challenges failed on the merits.The Seventh Circuit reversed and remanded, first holding that the plaintiffs have standing to bring both their as-applied and facial challenges before formal enforcement efforts because the statute has been used to harass and intimidate them and has caused them to refrain from engaging in activity protected by the First Amendment. Certain clauses of the law are unconstitutionally vague or overbroad. The statute discriminates against speech and expressive activity based on viewpoint and the defendants have not offered justifications for the provision that satisfy strict scrutiny. View "Brown v. Senate Bill 567 amended Penal Code section 1170(b)(2) to provide that when a statute specifies three possible terms of imprisonment, the court cannot impose a sentence exceeding the middle term unless it finds that a longer sentence is justified by “circumstances in aggravation of the crime” and “the facts underlying those circumstances” have been stipulated to by the defendant or have been found true beyond a reasonable doubt by the jury at trial. Before SB 567, trial judges had discretion to impose the lower, middle, or upper term of imprisonment based on their own assessment of which term best served the interests of justice, without making any factual findings.The court of appeal upheld a trial court order allowing the prosecution to amend an information to allege aggravating factors against a criminal defendant. Section 1170(b)(2)'s phrase “circumstances in aggravation” refers to the factors listed in California Rules of Court, 4.421; the Legislature has not violated the separation of powers by that delegation. The use of qualitative terms and the requirement that an aggravating circumstance make the commission of the offense distinctively worse does not render rule 4.421's factors unconstitutionally vague. The factual allegations supporting the aggravating circumstances do not need to be supported by evidence at the preliminary hearing. View "Zepeda v. Defendant Andrew Rhodius appealed the trial court’s denial of a full resentencing hearing under Penal Code section 1172.75. Defendant contended the trial court erred in denying him a full resentencing hearing on the basis that defendant’s prison priors were imposed and stayed, not imposed and executed. The Court of Appeal concluded after review that "interpret the statute to include enhancements that were imposed and stayed would be contrary to the legislative intent and the plain language of the statute." Appellant as next of kin and on behalf of a minor, J.T.A., and all similarly situated minors (“Appellants”), filed a class action lawsuit against the School Board of Volusia County, Florida for allegedly violating the minors’ rights to free appropriate public education (“FAPE”) in violation of the Individuals with Disabilities Education Act (“IDEA”) and the Americans with Disabilities Act (“ADA”). The Appellants appealed the district court’s order dismissing their amended complaint for failure to exhaust administrative remedies under the IDEA.   The Eleventh Circuit vacated the district court’s order of dismissal and remanded the case for further proceedings consistent with the holding in Perez. The court explained that here, Appellants seek compensatory and punitive damages. The IDEA provides neither. Thus, applying Perez to this case, Appellants can proceed without attempting to exhaust administrative remedies that do not exist under the IDEA. Appellants unambiguously sought compensatory monetary damages under the ADA and not compensatory education under the IDEA. Consequently, in light of Perez, the Appellants should have been allowed to proceed with their claims regardless of the IDEA’s exhaustion requirements. View "Kimberly Powell, et al. v. Plaintiffs challenge the Louisiana Legislature’s 2022 redistricting map for electing the state’s six members of the United States House of Representatives. The district court preliminarily enjoined use of that map for the 2022 congressional elections. The United States Supreme Court stayed that injunction, pending resolution of a case involving Alabama’s congressional redistricting plan. About a year later, the Supreme Court resolved the Alabama case.In review of the Louisiana Legislature's 2022 redistricting plan, the Fifth Circuit held that district court did not clearly err in its necessary fact-findings nor commit legal error in its conclusions that the Plaintiffs were likely to succeed in proving a violation of Section 2 of the Voting Rights Act. The Galveston County Commissioners Court is composed of four county commissioners, elected from single-member precincts, and one county judge, elected by the entire county. From 1991 to 2021, one of the four commissioner precincts had a majority-minority population, with blacks and Hispanics together accounting for 58 percent of the precinct’s total population as of 2020. In 2021, the Galveston County Commissioners Court enacted a new districting plan for county commissioner elections. The enacted plan does not contain a majority-minority precinct. Following a bench trial, the district court found that the enacted plan dilutes the voting power of the county’s black and Hispanic voters in violation of Section 2 of the Voting Rights Act.Galveston County appealed. The panel held that, under existing precedent, distinct minority groups like blacks and Hispanics may be aggregated for purposes of vote dilution claims under Section 2. However, disagreeing with the underlying legal analysis, the panel believed that such precedent should be overturned. Thus, the panel requested a poll for en banc hearing. View "Petteway v. In August 2023, the Mississippi Supreme Court granted Kelton Hathorne Sr.’s petition for writ of certiorari. Hathorne appealed a circuit court order that denied his motion for post-conviction collateral relief. On appeal, Hathorne argued his indictment was defective because it failed to charge a crime. The Court of Appeals agreed that the indictment was defective; however, it determined Hathorne’s claim was procedurally barred under the Uniform Post-Conviction Collateral Relief Act and, thus, affirmed the circuit court’s order. After review, the Supreme Court found the Court of Appeals erred by affirming the judgment of the circuit court and that Hathorne’s claim was not procedurally barred. In April of 2022,the Bureau of Alcohol, Tobacco, Firearms,and Explosives (“ATF”)issued a Final Rule in which the terms “firearm” and “frame or receiver,” among others, were given “an updated, more comprehensive definition. The Final Rule was almost immediately the subject of litigation claiming that ATF had exceeded its statutory authority, including this case.The Plaintiffs claimed that portions of the Final Rule, which redefine “frame or receiver” and “firearm,” exceeded ATF’s congressionally mandated authority. The plaintiffs requested that the court hold unlawful and set aside the Final Rule, and that the court preliminarily and permanently enjoin the Government from enforcing or implementing the Final Rule. The district issued, and then expanded upon, a preliminary injunction before granting Plaintiffs' motion for summary judgment, vacating the Final Rule.The Fifth Circuit held that the two challenged portions of the Final Rule exceeded ATF's authority.At this point, all that remained before the court was whether the appeal of the district court’s final judgment vacating the Final Rule in its entirety. In reviewing the district court's vacatur of the entire Final Rule, the court vacated the vactur order, remanding for further consideration of the remedy, considering the court’s holding on the merits. Davis and Allen pleaded guilty to using a facility of interstate commerce (their cellphones) in a murder-for-hire scheme, 18 U.S.C. 1958(a).The Sixth Circuit affirmed, rejecting an argument that the government could not constitutionally apply the federal murder-for-hire statute to their conduct. Although the statute rests on Congress’s power to regulate interstate commerce, the defendants never left Michigan or even made calls outside the state when committing the murder. At most, some of their intrastate calls required the telephone company to use out-of-state switches. The Supreme Court has held that Congress may regulate the “instrumentalities of interstate commerce” even when used only within a state, and the Sixth Circuit treats an ordinary telephone as one such “instrumentality” within Congress’s control. The court also rejected speedy-trial claims. Before they pleaded guilty, the district court had postponed their trial for nearly four years. But the delay arose in part from their own repeated requests for more time and in part from the COVID-19 pandemic. Both reasons justified the delay. View "United States v. Davis" on Justia Law

The First Circuit denied Petitioner's petition for review challenging the denial of her application for asylum and withholding of removal, holding that Petitioner failed to establish a connection between her past persecution on account of a statutorily protected ground.Specifically, the First Circuit held (1) Petitioner failed to raise before the Board of Immigration Appeals (BIA) her argument that the BIA's failure to address a procedural error in Petitioner's hearing before the IJ violated her right to due process under the Fifth Amendment, and therefore, this Court was precluded from addressing it now; and (2) the BIA erred by failing to evaluate the severity of Petitioner's mistreatment as a teenager through the eyes of a child, but the error did not warrant remand because Petitioner failed to link her mistreatment to a statutorily-protected ground.
